Legal hotel advice? HELPPP?

If you pay an agent to book you a room, and call to confirm your reservation the day before, to find out that the room has not been booked, and there is no availability, are they legally responsible to cover the monetary difference between the new accomodations and the ones you paid for and never received the service for?
